Wellington Street’s Churchill House set for Residential Conversion

Plans for a new city centre apartment complex on Wellington Street in Leeds have progressed as the partial demolition of Churchill House has been recommended for conditional approval.

The residential complex, which would be situated at the site of the grade II-listed office building, is set to include 22 apartments and a ground floor restaurant and cafe. The plans, drawn by Think Architecture + Design, also detail a seven-storey extension to the rear of Churchill House.

Head of agency at our Leeds office, Richard Dunn, commented, “The previous occupiers of Churchill House, Thompson Solicitors, moved in March 2016 to a refurbished 7,250 sq ft suite at Coverdale House. Since relocating them, the office building has remained vacant.”

An objection by Historic England means the application, which has been submitted by Barton Willmore on behalf of owner Hallborough Properties, will now be referred to government for a final decision.

Office to Residential Permitted Development Rights

Existing Office to Residential Permitted Development Rights (PDR): The PDR first came into force on 30 May 2013. It currently applies to any office building (occupied or vacant) that was lawfully used for this purpose (Use Class B1(a)) on 29 May 2013 or when it was last in use if it was vacant on 29 May 2013, subject to LPA prior approval of highways impact, contamination and flood risk. Offices which comprise listed buildings (including within the curtilage), scheduled monuments, or buildings within Sites of Special Scientific Interest (SSSI), safety hazard areas or military explosives areas do not benefit from the PDR. The existing PDR requires the residential use (Use Class C3) to begin by 30 May 2016. There are currently 33 exempted (whereby Article 4 directions are in existence; these remove permitted development rights) areas across 17 local authorities where the PDR does not apply. These local authorities include specific areas within most London Boroughs, the Vale of White Horse (Oxfordshire), Manchester, Stevenage Borough (Hertfordshire), Sevenoaks, Ashford Borough (both Kent) and East Hampshire District. The Prior Approval process is a ‘slimmed down’ type of planning application in that LPAs can only assess the 3 issues of highways, contamination and flood risk. In some cases it can be beneficial to submit transport statements/assessments, contamination assessments and Flood Risk Assessments (FRA) to demonstrate there will be no harmful impacts from the change of use or where there are harmful impacts, to demonstrate they can be adequately mitigated. Developments cannot begin until an LPA has issued a written notice of their determination that such prior approval is not required, or an LPA has issued a written notice giving their prior approval, or 56 days has passed since submission and an LPA has not notified the applicant whether prior approval is given or refused. LPAs can grant prior approval unconditionally or subject to conditions.
