During November the Chancellor of the Exchequer, Philip Hammond gave his first Autumn budget to parliament. There were a number of key changes affecting the housing sector and our residential expert, Diana Warr has summarised the impact of the budget here. One of the largest private collections of wheeled and tracked military vehicles, along with spares and memorabilia of over 500 lots is due to be sold by online auction, with bidding closing from 10 am on Wednesday 6th December. You can view the auction here.

Our machinery and business assets team also recently completed an auction of the assets of Pulse Flexible Packaging Ltd. The auction of modern flexible packaging production equipment was hosted on BidSpotter.co.uk and with the exception of auctions of classic cars and property; the auction holds the record for the high grossing auction ever seen on the site.

Our planning team has obtained two separate planning permissions for an additional 77 touring caravan pitches at Gateway Resort, Carmarthenshire.

We have recently been appointed by Leonard Cheshire Disability, a major UK health and welfare charity to sell three of their former care homes. Healthcare specialist at Sanderson Weatherall, James McKelvie commented, “The properties are full of character and offer potential purchasers excellent development opportunities. The properties have provided care to numerous individuals over many years and it would be brilliant to see a buyer put these sites into a productive use.”

We have recently provided valuation advice to assist a community led initiative in purchasing The Prince of Wales, Foxfield – a popular pub that was due to close. Lawrence Pinder, valuer in our Manchester team completed the valuation and commented, “It’s a really interesting project and it’s great to think that we have played a small part in trying to save a well-loved pub from closure and I wish them all the very best of luck.”

There is much speculation and crystal ball gazing surrounding the best time of the year to put your property on the market but unfortunately, it is not always an exact science. The best time to sell is affected by a number of factors; market demand, location and of course the property itself so don’t feel disheartened if you’ve heard the all too common words ‘now is not a good time to sell’.

“While traditionally December and early January have been the ‘slower’ month it is becoming one of the busiest times for traffic on property portals such as Rightmove. We find that when people are spending time with their family and close friends they use it to think about the year ahead and begin to consider their options.

“Whether you are considering moving house, renting in the city centre or perhaps you’re interested in available investment opportunities we would advise using the ‘free’ time that you have over the Christmas period to do your research. Valuation of pub to assist with community led takeover

We have recently provided valuation advice to assist a community led initiative in purchasing The Prince of Wales, Foxfield – a popular pub that was due to close. The pub is well known in the local area and among real ale enthusiasts as it prides itself on its ever-changing selection of beers, including a range from the connected Foxfield brewery.

A small steering group has been set up to create a cooperative where members of the community can buy shares in order to help keep the pub alive and they have also received backing from The Plunkett Foundation, a charitable organisation which specialises in community led schemes.

Lawrence Pinder, valuer in our Manchester team completed the valuation and commented, “A member of the steering committee approached us knowing that as a firm we had the expertise to provide them with valuation advice. As soon as we heard that the project was to be community driven and in part funded by a charitable organisation we offered to complete the work on a ‘pro bono’ basis.”

 Our Thoughts

Graham Isle, business rates expert in our Leeds team commented on today’s budget, focusing on the changes to business rates and how this will affect businesses across England and Wales.

“During the budget it was announced that from next April (2018) the annual rates increase will be based off the lower Consumer Price Index rather than the Retail Price Index. Before today’s announcement it had been promised that this change would be made in 2020 so it’s great to see the decision brought forward as early estimates indicate it could bring about a benefit of £2.3billion to small businesses over the next five years.

“It was also good to hear that following the next revaluation in 2022 the government plan to increase the frequency of revaluations from once every five years to once every three years. Moving forward this should ensure that business rates bills are more in line with properties market value and enable fairer bills to be generated.

“There was also welcome news for thousands of businesses occupying workplaces split across multiple floors as Hammond announced he would axe the staircase tax. Despite the ruling, businesses affected will need to continue paying their current bill until legislation is approved and the Valuation Office Agency make the amendments. Unfortunately, this may take time, which isn't good news for businesses in the short term. 

“Following the success of the business rates discount for pubs it was declared that this would be extended until May 2019, good news for the leisure sector as roughly 90% of pubs currently benefit from the £1,000 discount.

“In other news It was also announced that local authorities would now be able to charge 100% council tax on empty properties to penalise those with vacant properties and hopefully increase housing availability across the country.”

 “The abolishment of stamp duty is certainly a boost for first-time buyers across the country but with undoubtedly have a greater consequence for those purchasing higher value properties in London and the South.

“On top of the benefit to first-time buyers it is also good news for existing homeowners as the Office for Budget Responsibility has estimated that house prices will rise by 0.3% as a result of the change.

“It was also announced that local authorities would be able to charge a 100% council tax premium on empty properties. It is hoped that by charging penalties in the form of council tax payments it will dissuade landlords and property investors from leaving vacant houses and flats while many struggle to find somewhere to live.

“The government also pledged to support the “biggest annual increase in housing supply since 1970”. Hammond announced that to boost housebuilding the government would provide a minimum of £44bn of capital funding, loans and guarantees to help create an average of 300,000 new homes a year by the mid-2020s.

“With a number of promises of extra funding and re-allocation of resources the budget looks to be a promising one for the housing sector but as is often the case, we eagerly await the outcome of the changes.”

The auction was hosted on Bidspotter.co.uk, the online auction site. Latest statistics from the site show that with the exception of auctions of classic cars and property, this particular auction is the highest grossing auction ever seen on the site.

One of the more popular lots, a Bobst F&K 20 Six CI press, achieved a sale price in excess of £1.5million, making it not only the highest value lot in this auction but also the highest value lot to be sold through the site.

The two-day online auction took place on Wednesday 20th and Thursday 21st September with over 1,300 lots up for sale. There was a significant level of interest from potential purchasers throughout the world with more than 550 registered buyers from more than 20 countries including Canada, USA, Thailand, Singapore, India, Pakistan and various countries throughout Europe.

Commenting on the record breaking sale, Jonny Marston, partner at KPMG and joint administrator of Pulse Flexible Packaging, commented: “While we hoped that the auction would receive high levels of interest, we are delighted that Sanderson Weatherall was able to reach such a large number of potential buyers, helping to make the sale a real success and realising significant value for creditors of the administration.”

The stand out lots include Centurion, Chieftain & Abbot Tanks, Military Vehicles and a vast array of spares & memorabilia with a substantial collective value.

Stephen Jepson, associate partner in our Manchester office commented, “We’re used to advising clients on a variety of auctions, sales and negotiations and this is another very exciting instruction for the firm, but more importantly a unique opportunity for anyone interested in these fantastic lots. We have received an excellent response from the initial advertising with over 200 requests for catalogues to date from potential purchasers all over the globe.”

Melvin, formerly a gunner and instructor on Centurion tanks circa 1961-1968 has been acquiring military collectables since the early 70’s and has been lucky enough to live his “boyhood dream”.

Owen Pike, head of our planning team, commented, “I’m delighted that we were able to assist in a successful planning application for Gateway Resort.

“We coordinated the preparation and submission of the formal application drawings, technical reports and supporting documentation. It was a really interesting project as the site is located adjacent to an estuary where the water environment is protected. However this constraint meant our client had to agree to pay commuted sums towards the cost of removal of surface water flows from the public sewerage system. We therefore drafted the heads of terms for two section 106 agreements before our client’s solicitor agreed the final details.

“Following execution of the section 106 agreements and the grant of planning permission, we look forward to seeing the resort develop and the business flourish following as a result.”

Throughout the project our planning team worked in collaboration with Bob Lashley Design, Francis Sant Limited, Amber Environmental Consultancy Ltd and Gower Williams.
