Empty rates

The last government enacted a major change to the previous system of empty rates relief on 1st April 2008 and no further changes are currently in the pipeline. Now, empty rates are payable at a full 100% of occupied rates after the expiry of an initial void period, which may be either 3 months or 6 months, depending upon the type of commercial property. There are further, albeit very limited, exemptions available for listed buildings, storage land and small properties. Charitable organisations may also receive some relief, although extreme care should be taken, as complex limitations apply. Proper professionally qualified advice from a suitably qualified rating surveyor should be taken in all circumstances, as if a problem does arise, the outcome will probably be a rapid return to the full 100% charge with limited rights of redress. In most cases, the splitting up of these floors has been backdated to April 2015. Some, however, went as far back as 2010. With the removal of quantum allowances or small business rate relief, this has given rise to some significant backdated increases in both rateable value and resultant liability.

However, the splitting of assessments per floor hasn’t been carried out in a uniform manor and there are currently many inequities in the system.

It has also given rise to considerable despair on behalf of ratepayers who have received numerous and confusing rates bills with an end result of having a much higher liability! Ratepayers had been paying what they considered to be the correct tax over the last 5 years and the ‘staircase tax’ has therefore been met with considerable anger in the business community.

Previously, there was a much simpler rule for business occupiers – where a business occupied two or more adjacent floors within a multi-tenanted building, they would for rating purposes form a single assessment. Having a single assessment has many advantages to the ratepayer including the potential for a lower valuation per £/m and the potential for allowances.

The government has now fully acknowledged the unfairness of the current situation and has committed to reversing the unintended consequences of the Mazars ruling. The aim will be to reinstate VOA practice to that as it was prior to the decision. This will be in the form of revised legislation that will allow the VOA to ignore to some extent the new Mazars rules.

Sanderson Weatherall will continue to provide regular updates as the situation develops and once the legislation is finalised, and anticipate that proposals to take advantage of the new regulations could be made by the end of the financial year.

Graham Isle, partner in our business rates team commented on the report, “This was a very welcome report for the Scottish business rates system, much like the current system in England it is in dire need of reform.

“The report has highlighted a number of key recommendations to the Scottish Government and I look forward to hearing their response. In particular, it will be interesting to hear what Secretary for Finance, Derek Mackay has to say, as he welcomed the review’s publication and remarked that the government would respond swiftly”.

“I believe that the key recommendations within in the review are the call for more frequent revaluations and a reduction in the period between valuation and implementation of the new valuations, currently this takes two years and means at the start of each rating list many property valuations are already outdated.

“There are also calls for the small business bonus scheme to be evaluated, town centres to be provided with more support by expanding fresh start relief and the large business supplement reduced.”

Rates management

"Left to their own devices, most recipients of a non-domestic rates demand will get out their pocket calculator and check that the arithmetic is correct, then sign it off for payment" The arithmetic always will be - as the bill comes out of a computer! There is however rather more to a Rates bill than that. Rates Management is an additional service that professionally qualified Rates Liability specialists at Sanderson Weatherall provide to a growing number of rating clients. We arrange to receive business rates bills directly from the local billing authority, ratify and authorise these over a very short timescale, before reporting back to the client. Every account is given a multi-point check to ensure validity and accuracy. Where possible, we can often renegotiate instalment payments to aid the client's cash flow. Based on available information and taking the often complex transitional arrangements into account, we can then work with our clients to produce timely and accurate budget forecasts. If required, we can also arrange for the client to put us in funds to effect the payment of rates accounts by cheque, direct debit, BACS or most other methods. By outsourcing the process of rates bills, we can save our clients considerable time and money. If you have ever tried in vain to contact the correct person at a local billing authority, you will know how difficult and time consuming this can be! (The hours just slip by!) Rates relief process plagued by delays

The Government has recently intervened in an attempt to speed up business rates relief to thousands of small businesses across the country that have been adversely affected. Despite being promised millions of pounds of support in March’s Budget, many firms who lost small business rates relief as a consequence of the 2017 revaluation are still waiting for their bills to be adjusted and relief to be applied. During the 2017 revaluation the majority of businesses saw little change to their bills but it is estimated that there were nearly 25,000 small companies that lost their entitlement to small business rates relief and faced rates rises of up to 3,000%.

Following the increase of the threshold for small business rates relief, Chancellor Philip Hammond assured those companies that missed out that their bills wouldn’t go up by more than £50 a month.  These measures have been overcome by delays, with many Local Authorities stating they are unable to amend bills without further guidance being published by the Government.

A Department for Communities and Local Government spokesman said: "We've been clear that Local Authorities should take urgent steps to make sure small businesses benefit from the funding that we announced at the Budget in April.”

"There are Councils that have pressed ahead and issued revised bills. Others have chosen to wait for software updates to deliver this particular scheme and we've taken steps to make sure business get this relief as quickly as possible."
